We're aware of this problem, if you take a look at the 'Silk Road Known Bugs' thread you'll see it's marked as a 'P2' bug which means it's currently being investigated.

Auto-finalize is currently disabled, you'll need to wait for the resolution center to be released. Once it's been released you'll then be able to dispute the transaction and receive a full refund, here's a thread from Defcon where you can keep up to date with the latest features that are being released.

The commission is based on the price per item, if you list an item for $300 you'll pay 8% in commission. If you list an item for $5500 you'll pay 5% in commission,
$0-$499: 8%
$500-$4,999: 6%
$5,000-$9,999: 5%
$10,000-$19,999: 4.5%
$20,000+: 4%
