Title: Scam/misunderstanding

First of all, I'm new here, so I apologize if I overlooked something.

I bought something recently and the merchant immediately set it to "in transit", like so:
ordered: March 2, 2013, 1:15 am UTC
shipped: March 2, 2013, 1:25 am UTC

Soon he sends out a message like this:
"sorry... we have enough [nationality] buyers...try in 2 months oke?"

Now, it's "in transit", so not only did I not get my money back, I was also not able to order anything else. I asked him for the money, he replied:
"you have it back...if a seller cancels..."

Finally, when the "resolve" link was enabled, I sent out a request for 100%. It seems only fair: he never ever tried sending out the product and tied down my money. He had a great rating (100), so I assumed I could just wait it out.

When I finally come back to try to make a new purchase, I see this:
"I am sorry you could not come to a resolution. We have settled on a refund of 52%. I hope this is agreeable for you both.

Best regards,
Silk Road staff"

I asked him what the hell was with this. He replied:
"btc has gone uppppppppppppppppp in value...you see that....
so you have some value back again i think.."

So basically, he hijacked my money for a couple weeks and gambled with it. He essentially first forced me to gamble with my money and then stole the "winnings". Like, had he not falsely put "in transit", I would have had the money sitting in my SR account and could have enjoyed either new purchases or my exchange rate gains, now I got neither.

Any thoughts on whether I am thinking about this the wrong way or misunderstanding the way the site works? Seems like the merchant got the best of both worlds and I lost time or money, depending on which way you look at it.

Did you not keep up with it in the resolution center?  If you fail to reply for awhile, then the resolution center goes with the suggestion of the last person to post ... which, in this case, was the vendor.  If you don't reply and ask for 100% back, then the automatically go with that final post.

This is correct. He said he was going to return the money and he had a 100 rating, so I thought there was no need to monitor the request. But I accept that this is my mistake, not one of the system. Live and learn.

It's definitely still a shitty, shitty thing for the vendor to have done.

Since there seems to be some preliminary agreement that I have not misunderstood what happened here, perhaps it would be fair to let those interested know - the vendor is HollandOnline.

Did you report the vendor using the "report this vendor" link on their profile?  Might be worthwhile just to let SR Support know what's going on so if anyone else reports any problems, they can look into it.

Please be aware of HO.

I placed an order with him at the very beginning of March, we exchanged numerous PM's, he was extremely pleasant and I thought "this guy is going to be my regular".

Nothing arrived - dont believe it was ever sent.

I got a 15% fucking refund after ~3wks -- I went into my overdraft from the bank in order to purchase from him and thats how I get repaid?

He then tells me not to bother ordering from any other dutch xtc vendors as they are "his friends" and they have been told to scam me but if I send back the refund to him then he will give these vendors the "go-ahead" so that I dont get scammed by them.

I refused, obviously.

But seriously, he is an extremely pleasant, nice guy but a selective scammer who took me for a huge amount of money I didnt have - yes it was my fault for trusting him, but because of his rating I took the plunge.. wish I didnt now.

He has also included in his message about returning my refund, how to scam other vendors.

I have all messages to back up everything Im saying btw before anybody doubted me - I didnt take it to the forums (like i should have) out of the goodness of my heart, but since others are in the same boat then I thought i'd share my experience.
