Title: Shadh1 - full text of the sentence handed down

As noted by an eagle-eyed newbie, the full text of the Shadh1 case is available online here:   http://www.austlii.edu.au/au/cases/vic/VCC/2013/70.html

The whole thing is too long for one post (an edited version appears in the Newbie forum) but it is worth reading for those in Australia to find out how the judge came to the sentence, what circumstances added to the sentences and what were considered mitigating factors.

I was present at the sentencing hearing, which was 5-6 hours long, so may be able to answer any questions arising from the sentence.

He only got three and a half years!  You would have gotten like 20+ where I live in the US!  Australia has some nice drug laws.

The prosecutor and judge actually had what looked like a bit of a giggle over that.  He claimed they were bought for his wife's protection. The prosecutor said that most of them didn't work at all and the rest hardly gave a buzz.  :D

He sounds like a low life scum bag, dogging out his mates/supplier by giving the cops his number and rego details

The prosecutor said that the Victoria Police (who have jurisdiction) declined to act on the information. It was just weed.

Poor shadh1, it is a miserable thing. Sooner or later our community needs to find a way to prevent people falling through the cracks. Perhaps with BTC we can develop insurance contracts to make that happen, so there is a boost for somebody when they get out, or income for their families. I'm positive most vendors would be interested in paying a few thousand a year into such a scheme.

He barely got any trouble for the stun guns.  That site is down right now but I think it was a fine if I remember correctly.  Fake names and IDs and post office boxes in fake names would have have caused additional charges and more problems.

opening up pobox with fake id and importing narcotics breaks several commonwealth laws.. im guessing that would add another 'level of sophistication' to his little operation..     maybe even worse if you steal someone elses legit identity or use a completely fuddy duddy id,

10 Customs officers working at gateway facilities located in Melbourne and Sydney examined, over the period 27 March 2012 to 28 June 2012, twelve mail articles addressed to you at your flat in Brunswick West. Ten of the mail articles had been sent from the Netherlands, and two had been sent from Germany. Nine of those articles were found to contain various small amounts of MDMA in both powder and tablet form, and sealed within various items such as a DVD case, piece of card, a digital thermometer, and cigarette lighters. One shipment was concealed within a small torch which consisted of a clip-seal bag containing a brown crystalline substance wrapped in aluminium foil and with a net weight of 6.8 grams, being MDMA with a purity of 72.7 per cent. Two contained cocaine.


Does this mean that they deliberately let through shipments knowing they contained
controlled substance to build a case?

Ok so the way they found out the date he signed up to SR is only because he told him
and / or gave them the access to his vendor account? right.?

I think they went easy on him because of the number plate, it saved thousands of $$$ in police investigation time apparently as he advertised himself so well.

I do not like to see anyone suffer at the hands of the unjust CJS but fcuk me don't hand your ass to them on a plate.

Australia's laws are very different than the US or he squealed.  Where I live you would be lucky to get 20 years in prison for those charges.

Actually it's a fact that he squealed.  It said he gave up his dealer and they did nothing with the information.

I also disagree with your logic of only work with people that don't have a record.  How does that keep you safer???  People that have been through the system know how to handle themselves better with the system... practice makes perfect.  I've seem all sorts of noobs freak out about the slightest thing and get themselves in trouble... that's not going to happen to someone that's already done a 5 year stint.  People that have already done time... they know what BS LE will pull... they know what will happen to them if they snitch.  Assuming you have never been arrested... if you ever do, you're much more likely to turn than someone like me.  Jail/Prison don't scare me like it does you... I've already lived it.

Of course there will be exceptions to my loose forum post, but GENERALLY SPEAKING, for people who aren't absolutely boneheads, the less connections you have to others (i.e. avoiding syndicate behavior) , especially free of those with a government record to give grounds to be able to put pressure on... Probably a good thing!?

I'll agree about having as few clandestine connections to others is a good thing.  Less risk no matter who they are or what their background is.

But what makes you think ex-cons are more susceptible to pressure from LE???  TV???  People with records, the last thing they are willing to do is help the same fuckers that locked them up for god knows how long.  That's logic... not your fantasy speculation of  Law And Order/CSI Miami "lets go talk to the local ex-con" pressure.

Yoda may have not been caught... but he was basically banished to Dagobah.  Not much difference imo...

Well, I didn't read most of your post to tell you the truth, you were right re : Yoda... So I guess I will listen to our wise Star Wars pseudonym using convicted felon. You can always trust a felon !  But I generally ask for advice from career criminals who have never been caught . That's just me... The advice from those caught is usually painfully obvious...that is also just me though.

Wisdom comes from experience. Whether a criminal who has been caught, but also from one who hasn't
