You have answered your own question - you can easily prevent losing money to scams by NOT FINALIZING EARLY.

The only way to stop being scammed is to stop Finalising Early. People need to start having a modicum of personal responsibility when it comes to placing orders on Silk Road. It is up to each and every user to protect themselves from scams; Silk Road already does more than enough in that regard.
If it's part of a vendor's Terms & Conditions that you will have to FE, then to negate the risk of Finalising Early all you have to do is do your due diligence before ordering, and purchase from a vendor that does not require FE.
