Title: Resolution Center??? Does anyone have any experierence disputing a delivery??

I am getting ready to have to go to the resolution center per the Vendors request bc they are showing my package was delivered but I never received.  I have made over 30 + orders and this is the first one that has never shown up.  The vendor says that it was delivered and I never received.  It was not taken by anybody bc I was home at the time of the mail delivery and had another order show up from the SR the same day.  What r my chances of getting any kind of reship???  I personally do not want the refund bc I want the product.  At this point its the vendors word against mine, my stats are great and the vendor is very reputable.  The vendor has not really been that concerned or apologetic besides SEND IT TO RESOLUTION.  Does anyone have any insight to what I should do or what will probably happen to me??   :'(

You just need to make sure you submit all relevant information/evidence/messages you have that support your case through the RC. The vendor will have to provide some proof of delivery. If you can't agree on a settlement, an Admin will decide for you based on the facts of the case including any supporting documents submitted and your transaction histories (amongst other things). You can ask for a full 100% refund or any percentage you deem to be fair but if the vendor doesn't agree, the Admin will make the call.

Is it common practice to only get a refund??  I really just want the product I ordered but I doubt if the vendor would want to do that bc we are going to resolution.  Any thoughts??? :(

I think you need to do some more reading on how the resolution center works. Initially it is common practice to ask for an extension during which time you are free to try and work out a resolution with the vendor, if you want a reship then make a proposal for a reship, if the vendor declines your proposal then you are free to request a refund instead. The resolution admins will only become involved if you are unable to reach an agreement with the vendor, if that happens they will adjudicate on your case and make a determination, all SR resolution decisions are final. Obviously they cannot make the vendor reship to you but they can give a refund if it is considered appropriate. There is also the chance that none of your proposals are upheld though and the vendor is awarded 100% and you get nothing, it all depends on the merits of your case.

What would you recommend I do if the vendors only response back to me is send it to resolution??  Should i still keep contacting the vendor w a possible re ship or am i just wasting my time??

Please go and read how the resolution center (RC) works in the SR wiki.

Take the transaction into the RC and submit the proposed resolution you are seeking, the vendor will then either accept it, decline it or make a counter proposal themselves that you can either chose to accept, decline or make another proposal.

This really depends on the circumstances. Without knowing much about this, the most basic advice I have is, go thru resolution centre, and state your facts clearly.

The shipper says it arrived? OK, then he must have purchased a tracking #. Did you get that and verify the details of the tracked package? If he will not provide you with this proof, then he has no grounds to say it arrived, and you should do as stated above by everyone else. For the time being, forgo releasing paymenty, and take this up with the resolution centre to state and state your case. They will sort it out there for you..

If the vendor is saying it was delivered then they must have some evidence to prove that i.e. tracking information. At this point in time they should be making that information available to you so you can check for yourself.

All the vendor has done is sent me this info i am copying and pasting from a message from the vendor Here's the tracking results:

Oh ok sorry didnt think about that.  Thank you!!!  Anyway that info is all i have is that enough for the vendor to say i received it, I thought it looked like something i could make using word??

I didn't read it, I was more concerned with deleting it as fast as possible.

Please direct all resolution matters to the resolution staff on the market site, you are unable to get specific assistance with your resolution claims here beyond general advice, moderators have no involvement in administrative duties on the market site, the forums and market site are entirely separate.

It is impossible to say as each case is considered individually taking into consideration a number of factors. If you have good stats, have very low refund rate etc that will add weight to your case. If the tracking also shows the shipment as delivered though that is generally and end to the matter yes unless there have been other instances of buyers reportedly experiencing the same issue, if that has happened it may influence the admins to consider your version over the vendors.

It's a tough call to make, all you can do is submit your resolution proposal and detail your circumstances as clearly and as succinctly as possible in a non emotive manner so the admins can easily get a grasp of what you are saying. Some people like to write novels on nonsensical emotive rambling allegations that are very hard to decipher, doing that most certainly does not help your case.

Keep it simple, factual and to the point.

well I got great stats and the vendor has shit stats and he got the money ? work that out ..
